1. Agreement to Terms

By accessing or using Eto ("the Service"), operated by ETO, a business entity founded and based in Finland, you agree to be bound by these Terms of Service ("Terms"). If you disagree with any part of these Terms, you may not access the Service.

These Terms apply to all users of the Service. By using the Service, you acknowledge and agree that you are solely responsible for all activity conducted through your account and for all decisions you make based on information or tools provided by the Service.

2. Description of Service

Eto is an e-commerce productivity platform that provides tools and services for managing Etsy stores, including but not limited to:

Product research and market analysis
Keyword research and SEO optimization
Store management and listing management
Order processing and customer support automation
Inventory and profit analysis
Virtual assistant task management

All market research data provided through the Service is derived exclusively from publicly available sources. We reserve the right to modify, suspend, or discontinue any part of the Service at any time, with or without notice.

3. Account Registration

3.1 Account Requirements

To use the Service, you must:

Be at least 18 years of age
Provide accurate, current, and complete information during registration
Maintain and update your information to keep it accurate
Maintain the security of your account credentials
Accept responsibility for all activities under your account

3.2 Account Security

You are responsible for maintaining the confidentiality of your account password and for all activities that occur under your account. You agree to notify us immediately of any unauthorized use of your account.

4. Subscription and Payment

4.1 Subscription Plans

The Service is offered on a subscription basis. We may offer a free trial period for new users. After any trial period, you will be charged the applicable subscription fee unless you cancel before the trial ends.

4.2 Payment Terms and No-Refund Policy

Payment is due in advance for each billing period
All subscription fees are non-refundable. By purchasing a subscription, you expressly acknowledge and agree to this no-refund policy
No partial refunds, pro-rated refunds, or credits will be issued for any reason, including but not limited to early cancellation, dissatisfaction with the Service, or failure to use the Service during a billing period
We reserve the right to change our pricing with 30 days' notice. Price changes will apply to the next billing period following the notice
Failed payments may result in suspension or termination of your account

Consumer Protection Notice: Notwithstanding the foregoing, this no-refund policy is subject to, and does not override, any mandatory consumer protection or refund rights provided by applicable law in your jurisdiction, including but not limited to EU consumer protection regulations and Finnish consumer law. Where local law grants you a statutory right to a refund, ETO will comply with such legal requirements.

4.3 Cancellation

You may cancel your subscription freely at any time, with no cancellation fees or penalties. Your subscription is not binding beyond the current billing period. Upon cancellation, you will retain access to the Service until the end of your current paid billing period, after which your access will revert to any available free-tier functionality or be suspended.

5. Acceptable Use

You agree not to:

Use the Service for any illegal purpose or in violation of any laws
Violate any third-party rights, including intellectual property rights
Violate the terms of service of Etsy or any other third-party platform that you access through or in connection with the Service. Eto requires all users to fully comply with Etsy's Terms of Use, Etsy's Seller Policy, and all other applicable Etsy policies at all times
Use the Service in any manner that is unethical, deceptive, or harmful to other marketplace participants
Transmit any viruses, malware, or harmful code
Attempt to gain unauthorized access to the Service or related systems
Interfere with or disrupt the Service or servers
Use automated systems to access the Service without permission
Reverse engineer, decompile, or disassemble any part of the Service
Resell, redistribute, or sublicense the Service without authorization
Use the Service to compete with Eto or build a similar service

Etsy Terms of Service Compliance: Eto expects and requires all users to use this platform ethically and in full compliance with Etsy's Terms of Use. We do not condone, encourage, or support any activity that violates Etsy's policies. Any user found to be using Eto in a manner that violates Etsy's Terms of Use will be permanently suspended from the Service without refund. The founder of ETO has never violated Etsy's Terms of Use, does not condone any violation of Etsy's Terms of Use, and is not aware of any user violating Etsy's Terms of Use through this platform.

6. Third-Party Services and Integrations

The Service integrates with third-party platforms, including Etsy, Gmail, and other services. By connecting these services:

You grant us permission to access and use data from these services solely to provide the functionality you have requested
You are responsible for complying with the terms of service of third-party platforms
We are not responsible for the availability, accuracy, or content of third-party services
Third-party service changes may affect the functionality of our Service

Etsy Compliance Obligation: By connecting your Etsy account to Eto, you affirm that you will use the Service in full compliance with Etsy's Terms of Use, Seller Policy, and all other applicable Etsy policies. You acknowledge that ETO is not responsible for ensuring your compliance with Etsy's policies, and that any consequences arising from your violation of Etsy's terms are solely your responsibility.

The term 'Etsy' is a trademark of Etsy, Inc. This application uses the Etsy API but is not endorsed or certified by Etsy, Inc.

7. Intellectual Property

7.1 Our Intellectual Property

The Service and its original content, features, and functionality are owned by ETO and are protected by international copyright, trademark, patent, trade secret, and other intellectual property laws.

7.2 Your Content

You retain ownership of any content you upload or create using the Service. By using the Service, you grant us a license to use, store, and process your content solely for the purpose of providing the Service.

8. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which is incorporated into these Terms by reference.

Eto is a privacy-centric platform. We do not collect, store, or monitor your search queries, research activity, usage patterns, or behavioral data. All market research data provided through the platform is sourced exclusively from publicly available information. For complete details on our data practices, please review our Privacy Policy.

We implement security measures to protect your data, including encryption of API keys and access tokens. However, we cannot guarantee absolute security. You are responsible for maintaining the security of your own account credentials and for backing up your data.

9. Disclaimers and Limitations of Liability

9.1 Service Availability

The Service is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the Service will be uninterrupted, error-free, or completely secure.

9.2 Limitation of Liability

To the maximum extent permitted by law, ETO shall not be liable for any indirect, incidental, special, consequential, or punitive damages, or any loss of profits or revenues, whether incurred directly or indirectly, or any loss of data, use, goodwill, or other intangible losses.

9.3 Business Decisions

The Service provides tools and information to assist with business decisions. However, you are solely responsible for your business decisions and outcomes. We do not guarantee any specific results from using the Service.

9.4 User Actions and Responsibility

Everything you do on Eto is your own responsibility. ETO is not responsible for any actions you take using the Service, including but not limited to business decisions, marketplace listings, pricing decisions, customer interactions, or any consequences arising from your use of data or tools provided by the Service. You assume all risk associated with your use of the Service and any decisions made in reliance upon information obtained through it.

9.5 Data Breach Limitation

In the event of a security breach or unauthorized access to data stored on our platform, ETO, its founder, employees, officers, and agents shall not be held liable for any direct, indirect, incidental, special, consequential, or punitive damages, including but not limited to loss of data, loss of revenue, or business interruption, to the maximum extent permitted by applicable law.

9.6 Right to Legal Recourse

Notwithstanding the limitations above, if ETO or its founder directly and demonstrably mishandles your connected store, products, or account data through negligent or intentional action, and you can provide clear and undeniable evidence of such mishandling and resulting damages, you retain the right to pursue legal recourse against ETO in accordance with Section 15 (Governing Law and Dispute Resolution) of these Terms.

10. Data Sources and Legality

All market research data, product information, and marketplace analytics provided through the Service are derived exclusively from publicly available sources. Eto does not access any private, restricted, or non-public data. The collection and presentation of publicly available marketplace data does not violate any applicable laws or regulations.

Eto's research tools aggregate and analyze information that is freely accessible to any member of the public through the Etsy marketplace and other public sources.

11. Unofficial Communications and Community Channels

ETO may operate or be associated with community channels, including but not limited to a Discord server. Any such community channels are entirely unofficial and are not part of the Service. The following applies to all unofficial community channels:

Nothing discussed, shared, or communicated in unofficial community channels (including Discord) constitutes an official statement, representation, or commitment by ETO
Content in unofficial channels cannot be used as evidence of ETO's policies, practices, or positions in any legal or dispute resolution proceeding
Unofficial channels exist solely for informal community interaction and non-binding updates
ETO assumes no responsibility for content posted by third parties in community channels

Official communications from ETO will be made through the Service itself, via email from official ETO email addresses, or through updates to these Terms and our Privacy Policy.

12. Indemnification

You agree to indemnify, defend, and hold harmless ETO and its officers, directors, employees, and agents from and against any claims, liabilities, damages, losses, and expenses, including reasonable attorneys' fees, arising out of or in any way connected with:

Your use of the Service
Your violation of these Terms
Your violation of any third-party rights, including the terms of service of Etsy or any other connected platform
Any content you submit or transmit through the Service

13. Termination

13.1 Termination by You

You may terminate your account at any time by canceling your subscription and deleting your account through the Service settings.

13.2 Termination by Us

We may suspend or terminate your account immediately, without prior notice, if you:

Violate these Terms of Service
Engage in fraudulent, abusive, or illegal activity
Fail to pay subscription fees
Use the Service in a manner that could harm us or other users
Violate the terms of service of Etsy or any other connected third-party platform, which shall result in permanent suspension

13.3 Effect of Termination

Upon termination, your right to use the Service will immediately cease. We may delete your account and data, though we may retain certain information as required by law or for legitimate business purposes.

14. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes by posting the updated Terms on this page and updating the "Last updated" date. Your continued use of the Service after such changes constitutes acceptance of the new Terms.

If you do not agree to the modified Terms, you must stop using the Service and may cancel your subscription.

15. Governing Law and Dispute Resolution

These Terms shall be governed by and construed in accordance with the laws of Finland, without regard to conflict of law provisions. Any disputes arising from these Terms or the Service shall be subject to the exclusive jurisdiction of the courts of Finland, unless mandatory consumer protection laws in your jurisdiction provide otherwise.

For users located within the European Union, nothing in these Terms affects your rights under mandatory EU consumer protection regulations, including your right to bring proceedings in the courts of your country of residence.

16. Miscellaneous

16.1 Entire Agreement

These Terms, together with our Privacy Policy, constitute the entire agreement between you and ETO regarding the Service.

16.2 Severability

If any provision of these Terms is found to be unenforceable, the remaining provisions will remain in full effect.

16.3 Waiver

Our failure to enforce any right or provision of these Terms will not be considered a waiver of such right or provision.
